Next Stop: Supreme Court


In case you haven’t already heard the latest legal nail-biter to hit the dockets in Los Angeles, look no further: Sprinkles Cupcakes, the California cupcake retailer catering to Hollywood’s elite, has filed a federal lawsuit against its competitor, Famous Cupcakes, for “stealing its trademarked ‘Modern Dot’ cupcake design to lure away clientele.”

Sprinkles is claiming that Famous Cupcakes has incorporated the “nested circle design” featured on Sprinkles cupcakes on Famous’ packaging, store decor, and “each and every page” of its website. The lawsuit has also alleged that, unlike other cupcake capers around the world who ceased using “Modern Dot” after being caught by Sprinkles, Famous “has not responded to repeated requests to ‘promptly stop using its trademarked design.’”

In related news, word’s just hit the legal wires that the Saperstein family of Brentwood has just been sued by IHOP for incorporating its famous “whipped cream funny face” pancake design at their 4-year-old twins’, Max and Ella’s, birthday brunch last Sunday. Will keep you posted.  [Reuters]
